AG Balderas Issues Consumer Advisory on Increased Cost and Unavailability of Infant Formula

ALBUQUERQUE – Today, New Mexico Attorney General Hector Balderas issued the following statement and advisory to all New Mexicans in response to reports of rising costs and unavailability of baby formula.

The New Mexico Office of the Attorney General (NMOAG) is investigating reports of increased cost and reduced availability of baby formula in New Mexico. It is the Attorney General’s belief and understanding that the federal government, including the Federal Drug Administration (the “FDA”) is working around the clock to get formula to shelves, indicating it would announce plans to streamline formula imports.

“Consumers who have concerns about product safety or excessive pricing when purchasing infant formula are urged to immediately contact my office,” said Attorney General Balderas.

Consumers are advised that the following business practices may be against the law:

  1. Price gouging, or significantly increasing the price of available infant formula beyond its cost;
  2. Representing that a product is infant formula when it is something else; or
  3. Representing that a product is safe when it is not, for example, representing that an infant formula is safe, when it is actually one of the formulas that were recalled.
